The existing early access terms for the One-Home website and associated services.
1. Scope and product status
These terms of use apply to the one-home.online website, My One-Home, available downloads and One-Home Cloud features. One-Home is currently in early access/development. Product features, supported One-Links, prices and commercial terms may therefore change before version 1.0.
If you later purchase a paid product, subscription or installation, additional order, licence, service or hardware terms may apply. In the event of a conflict, specifically agreed terms take precedence over these general website/platform terms.
2. Account and security
You are responsible for providing accurate account information and keeping your password, authentication methods and recovery codes secure. Do not share login credentials with unauthorised persons. Report suspected misuse or account takeover as soon as possible.
One-Home may require reasonable security measures, such as email verification or two-step verification, particularly for administrative functions. Accounts may be temporarily restricted where reasonably necessary to investigate misuse, a security incident or unauthorised access.
3. One-Home Core and local-first use
One-Home combines local software with optional cloud features. The guiding principle is that existing local home controls and automations are not deliberately made dependent on permanent cloud connectivity. However, some third-party One-Links themselves require internet access or an external cloud service.
The user/administrator remains responsible for suitable hardware, a secure local network, correct installation, updates to the underlying operating system and secure access to the host on which One-Home runs, unless otherwise agreed in writing.
4. Software licence and permitted use
Unless a separate licence provides otherwise, you receive only a limited personal or organisational right to use the One-Home software and services associated with your account/entitlement. Ownership of the software, design, branding, documentation and other intellectual property rights is not transferred.
You may not use the service to circumvent security measures, misuse other people's accounts, distribute malware, disrupt systems or infringe third-party rights. This provision does not affect reverse engineering permitted under mandatory law.
5. One-Links and third-party services
One-Home can connect to products, APIs and services from other brands. These third parties may change their APIs, authentication, functionality, pricing or terms. As a result, a One-Link may work less well or ultimately become unsupported, without One-Home having caused that change.
Mentioning a brand or compatibility does not automatically mean that the manufacturer sponsors, certifies or supports One-Home. For commercial sales, an up-to-date compatibility list should specify what is officially supported.
6. No substitute for life-safety systems
One-Home is a smart home platform and is not a substitute for legally required or certified fire alarm, intruder alarm, medical, care, access control or other life-safety systems, unless a specific One-Home feature is expressly certified and offered as such.
Automations may fail due to power outages, network problems, device faults, changed APIs or human configuration errors. Do not use an automation as the sole safety measure where a failure could cause injury, fire, damage or another dangerous situation.
7. Updates, releases and support
One-Home may offer software updates, security fixes and new features. Release channels such as internal, beta or stable may have different risk profiles. Early access versions may contain bugs and are not intended for situations requiring uninterrupted operation.
The platform is designed to verify official release data before applying updates. The exact commercial update period, support duration and end-of-support terms are specified for each offering.
8. Cloud availability and backups
Cloud features are additional online services and may be temporarily unavailable due to maintenance, faults, security measures or circumstances beyond reasonable control. One-Home aims for high availability but does not guarantee uninterrupted cloud availability without a separate SLA.
Cloud backups are an additional provision. You remain responsible for securely storing recovery keys and maintaining an appropriate backup strategy of your own. An irretrievably lost key may make it impossible to recover locally encrypted data.
9. Prices, subscriptions and payments
Until One-Home has launched commercially, displayed prices may be indicative or not yet determined. At a paid launch, at least the total price, any taxes/charges, subscription duration, cancellation method and essential product characteristics will be clearly displayed before an order is placed.
For recurring services, the billing period is stated in the offer. A price change for an ongoing consumer subscription will only be applied in accordance with the agreement and applicable law, with advance notice where required.
10. Consumers: cooling-off period, conformity and cancellation
If you purchase a product or service online as a consumer, mandatory consumer rights may apply. Distance purchases are in many cases subject to a statutory cooling-off period of 14 days. Specific rules apply to digital content or services regarding delivery during that period and any loss of the right of withdrawal or payment due on withdrawal.
When One-Home enables paid online sales, the ordering process will include the legally required pre-contractual information and an accessible digital means of withdrawing from an agreement within the applicable cooling-off period where that right exists. These terms do not limit statutory rights to a satisfactory/conforming product or digital service.
11. Early access and beta
Early access, internal and beta versions are intended for testing and improving the product. Functionality may change, become temporarily unavailable or be redesigned. Always make your own backup of critical data before installing an early access update.
One-Home may use feedback on early access features to improve the product without transferring ownership of your existing ideas, data or other rights.
12. Privacy
The processing of personal data is described in the Privacy notice. The use of local One-Links may also be subject to third-party privacy terms.
13. Intellectual property and branding
One-Home, the One-Home name, logos, interface designs, software, text and documentation are protected to the extent that intellectual property rights apply to them. You may not use branding in a way that presents you as an official partner, reseller or representative without permission.
14. Liability
Nothing in these terms limits liability that cannot be excluded or limited under mandatory law. For business use, additional limitations of liability may be agreed in specific commercial agreements.
As One-Home may depend on local hardware, networks and third-party services, there is no guarantee that every One-Link or automation will always be available. Users must take reasonable precautions for situations in which a failure could cause damage.
15. Suspension, termination and export
You may terminate an account or optional cloud feature using the options offered in the Customer Portal or the relevant agreement. One-Home may restrict access in cases of serious misuse, fraud, security risks or legal obligations, but seeks to limit the impact on local home functionality where reasonable.
Where technically and legally applicable, information will be provided about exporting or deleting account data. Some administrative or security data may continue to be retained temporarily after termination or for as long as required by law.
16. Governing law and changes
To the extent legally valid, an agreement with the eventual Dutch operator is governed by Dutch law. Mandatory consumer protections of the country where a consumer habitually resides continue to apply where required by law.
Material changes to these terms will be published with a new date and communicated in advance where required for an ongoing agreement. Full company details and the relevant dispute resolution/contact information will be added before the commercial launch.
